The Data Act is a key pillar of the European Data Strategy and marks the second major initiative that has been announced. The Act is intended to provide horizontal legislation for sharing non-personal data, by introducing obligations that allow users access to the data they contribute to generating. It will also ensure that public bodies can access to privately-held data under exceptional circumstances.
The Confederation of Swedish Enterprise is Sweden’s largest and most influential business federation. It represents 49 member organisations and 60,000 member companies. The Confederation of Swedish Enterprise fully supports initiatives that aim at creating a more vibrant data economy. However, the scope of the Data Act must be proportionate and should nurture a market-driven approach, and only providing for interventions where a market failure takes place.
A well-designed Data Act, one that comply with existing policy provisions in the digital policy area, could encourage stakeholders to share data with appropriate safeguards, encouraging innovation and creating a positive investment climate in the sector.
